API Usage Policy

The terms and conditions for accessing and using the APIs provided by Refari Pty Ltd. Please read this Policy carefully before integrating with our APIs.

Section 1

1. Introduction

This API Usage Policy ("Policy") sets out the terms and conditions for accessing and using the APIs (Application Programming Interface) provided by Refari Pty Ltd (the "API Provider"). By accessing or using the APIs, you are agreeing to be bound by the terms and conditions of this Policy. If you do not agree to these terms and conditions, you are not authorised to access or use the APIs.

2. Use of the APIs

The APIs are provided solely for the purpose of enabling developers to access and use the services and functionality provided by the API Provider. You are authorized to use the APIs only in accordance with the terms and conditions of this Policy and any applicable agreements between you and the API Provider.

Section 3

3. Restrictions on Use

You agree not to:

(a)
Use the APIs for any illegal or unauthorized purpose.
(b)
Transmit any viruses or other harmful code through the APIs.
(c)
Attempt to gain unauthorized access to Refari Pty Ltd's systems or networks.
(d)
Use the APIs in a manner that could damage, disable, overburden, or impair Refari Pty Ltd's systems or networks.
(e)
Use the APIs in a manner that could interfere with other users' use and enjoyment of the APIs.
(f)
Use the APIs to scrape or harvest data from Refari Pty Ltd's systems or networks.
(g)
Attempt to circumvent any security or usage limitations placed on the APIs.
Section 4

4. Relationship to the Terms of Use

Your access to and use of the APIs is also governed by the Refari Terms of Use (terms.refari.co), which are incorporated into this Policy by reference. This Policy supplements those Terms; if there is any inconsistency regarding your use of the APIs, this Policy prevails to the extent of the inconsistency. Third parties who are provided access to the Refari platform for API testing or integration purposes are bound by those Terms.

5. Security

You are responsible for maintaining the confidentiality and security of any credentials or other information used to access the APIs. You must immediately notify Refari Pty Ltd if you become aware of any unauthorized use of your credentials or other information.

Section 6

6. Data Protection

Where your use of the APIs involves accessing or receiving personal information of candidates, referrers, hiring managers or other individuals, you must:

(a)
comply with all applicable data protection and privacy laws, including the Privacy Act 1988 (Cth) and, where relevant, the General Data Protection Regulation (GDPR);
(b)
use that personal information only as necessary to use the Services in accordance with this Policy and any applicable agreement between you and the API Provider;
(c)
maintain appropriate security safeguards to protect it;
(d)
not disclose, sell or onward-transfer it except as permitted by the relevant individual or required by law; and
(e)
delete it when it is no longer required, or on termination of your access, unless retention is required by law.

You are responsible for your own obligations as a separate controller or processor of that personal information. Refari's own handling of personal information is described in our Privacy Policy at privacy.refari.co.

Section 7

7. Modification and Discontinuation of APIs

Refari Pty Ltd reserves the right to modify, suspend, or discontinue the APIs at any time, with or without notice. Refari Pty Ltd will make reasonable efforts to communicate any changes that will have a significant impact on any third-party integrations.

Section 8

8. Usage Limitations

Refari Pty Ltd reserves the right to impose or add usage limits at any time and without notice, in order to ensure the fair and equitable usage of the APIs by all users, and to prevent overuse or abuse of the APIs. These usage limits may be based on various factors such as the number of API calls, data usage, and other usage parameters.

9. Termination

Refari Pty Ltd may terminate your access to the APIs at any time if you breach any of the terms and conditions of this Policy.

10. Disclaimer of Warranties

The APIs are provided "as is" and "as available" without warranty of any kind, either express or implied. Refari Pty Ltd does not warrant that the APIs will be uninterrupted or error-free.

Section 11

11. Limitation of Liability

In no event will Refari Pty Ltd be liable to you or any third party for any damages, including but not limited to any lost profits, lost savings, or any incidental, consequential, special, or similar damages arising out of or in connection with the use or inability to use the APIs, even if Refari Pty Ltd has been advised of the possibility of such damages.

12. Changes to this Policy

Refari Pty Ltd may revise this Policy from time to time. The current version will be posted at this page with an updated date. Where a change materially affects your integration, we will make reasonable efforts to notify you. Your continued access to or use of the APIs after a change takes effect constitutes your acceptance of the revised Policy.

Section 13

13. Governing Law

This Policy shall be governed by and construed in accordance with the laws of New South Wales, Australia without giving effect to any principles of conflicts of law.
